Analisis Penerapan Hukum Keluarga Islam Berbasis Maqashid Al-Syari’ah

Penelitian ini bertujuan menganalisis penerapan hukum keluarga Islam di Indonesia berbasis maqāṣid al-syarī'ah serta merumuskan model penerapannya dalam menghadapi persoalan keluarga kontemporer. Penelitian ini menggunakan metode hukum normatif dengan pendekatan kepustakaan (library research) dan pendekatan konseptual. Data diperoleh dari Al-Qur'an, hadis, Kompilasi Hukum Islam, peraturan perundang-undangan, dan literatur ilmiah yang relevan, kemudian dianalisis secara kualitatif melalui analisis isi. Hasil penelitian menunjukkan bahwa penerapan hukum keluarga Islam di Indonesia bersifat integratif, dinamis, kontekstual, dan berorientasi pada kemaslahatan. Konsep maqāṣid al-syarī'ah, khususnya ḥifẓ al-dīn, ḥifẓ al-nafs, ḥifẓ al-'aql, ḥifẓ al-nasl, dan ḥifẓ al-māl, dapat menjadi landasan dalam memahami dan menerapkan hukum keluarga secara substantif. Model yang ditawarkan adalah integratif-kontekstual berbasis kemaslahatan melalui identifikasi norma, tujuan syariat, analisis maslahat dan mafsadat, kontekstualisasi, serta evaluasi penerapan hukum.
